Pup Pass Terms of Service

Welcome to Pup Pass, operated by Sidewalk Dog ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of the Pup Pass mobile application and related services (collectively, the "Service").

By using Pup Pass, you agree to these Terms. If you do not agree, do not use the Service.

1. Overview of the Service

Pup Pass is a membership-based platform that provides access to special offers, perks, and experiences at participating dog-friendly businesses.

Pup Pass does not own or operate the businesses listed in the app. All offers are provided directly by participating locations.

2. Eligibility

You must be at least 18 years old to use Pup Pass.

By using the Service, you confirm that:

  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations

3. Membership & Subscription

3.1 Subscription Terms

Pup Pass may offer monthly or annual subscriptions.

  • Subscriptions automatically renew unless canceled
  • Billing is handled through your app store provider (Apple or Google)
  • Pricing is subject to change with notice

3.2 Cancellation

You may cancel your subscription at any time through your app store account settings.

  • Cancellation prevents future billing
  • No refunds are provided for unused time, except where required by law

4. Use of Offers & Perks

4.1 General Rules

  • Offers are limited to one use per user unless otherwise specified
  • Offers may vary by location and are subject to change
  • Businesses may have additional terms or restrictions

4.2 No Cash Value

Offers and perks:

  • Have no cash value
  • Cannot be transferred, resold, or exchanged

4.3 Business Participation

Participating businesses may:

  • Modify or discontinue offers at any time
  • Refuse service for valid reasons (e.g., safety, capacity, policy violations)

5. User Conduct

You agree not to:

  • Share, duplicate, or misuse your account
  • Attempt to exploit or abuse offers
  • Use the Service for unlawful purposes
  • Harass businesses or other users

We reserve the right to suspend or terminate accounts that violate these rules.

6. Account & Access

You are responsible for:

  • Maintaining the confidentiality of your account
  • All activity under your account

We may suspend or terminate access if:

  • We suspect fraud or misuse
  • You violate these Terms

7. No Guarantee of Availability

We do not guarantee:

  • That offers will always be available
  • That all businesses will continue participating
  • That the Service will be uninterrupted or error-free

8. Payments & Billing

All payments are processed through third-party platforms (e.g., Apple App Store, Google Play).

We do not store or manage your payment details directly.

For billing issues, you must contact your app store provider.

9. Limitation of Liability

To the fullest extent permitted by law:

Pup Pass is provided "as is" without warranties of any kind.

We are not liable for:

  • The quality, safety, or experience at participating businesses
  • Any injuries, damages, or losses incurred during use of offers
  • Errors, interruptions, or downtime in the app

10. Indemnification

You agree to indemnify and hold harmless Sidewalk Dog and its affiliates from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your interactions with participating businesses

11. Changes to the Service or Terms

We may update:

  • The Service
  • These Terms

We will provide notice of material changes. Continued use of the Service constitutes acceptance of the updated Terms.

12. Termination

We may suspend or terminate your access at any time if:

  • You violate these Terms
  • We discontinue the Service

13. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles.
